By accessing, downloading, installing, or using the SuperCat.AI mobile application (the "App" or "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

The Service is intended for users who are:

• At least 13 years old (or 14 years old in South Korea, 16 years old in the EU)
• Legally capable of entering into binding contracts
• Parents or legal guardians may create accounts for children under the age requirements

Some features of the Service may be subject to additional terms and conditions, which will be presented to you when you access those features.

SuperCat.AI is an artificial intelligence-powered mobile application that:

Core Features:

• Analyzes cat meow recordings to identify emotions
• Provides daily, weekly, and monthly emotion reports
• Offers AI-powered chatbot for cat care advice
• Translates human speech into cat-like sounds
• Automatically detects and analyzes cat meows in the background
• Creates personalized AI models for individual cats

Additional Features:

• Emotion calendar and tracking
• AI training system for improved accuracy
• Sound storybook with photos
• Bond score tracking
• Cat profile management

We reserve the right to:

• Modify, suspend, or discontinue any feature of the Service
• Add new features or functionality
• Change the scope or availability of features

We will provide notice of significant changes when reasonably possible.

Some features may be designated as "beta" or experimental. These features are provided "as is" and may contain errors or function differently than final releases.

Minimum Ages:

• United States & International: 13 years old
• South Korea: 14 years old
• European Union/EEA: 16 years old (or lower as set by your country)

Children Under Age Requirements:

• Must have verifiable parental or guardian consent
• Parent/guardian is responsible for the child's use of the Service

To create an account, you must:

• Provide accurate and complete information
• Maintain and update your information
• Keep your password secure and confidential
• Not share your account with others
• Notify us immediately of any unauthorized access

You are responsible for:

• All activities that occur under your account
• Maintaining the security of your account
• Any content uploaded or actions taken through your account

Required Information:

• Email address (for account creation)
• Password (encrypted and stored securely)
• Cat profile information (name, breed, date of birth)

Optional Information:

• Cat profile photo
• Location preferences
• Notification settings

You must:

• Choose a strong, unique password
• Never share your password with anyone
• Change your password if you suspect unauthorized access
• Log out from shared devices

We may suspend or terminate your account if:

• You violate these Terms
• You provide false or misleading information
• You engage in fraudulent or illegal activity
• We are required to do so by law

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal device
• Access and use the Service for personal, non-commercial purposes

You may NOT:

• Use the Service for commercial purposes without our permission
• Modify, reverse engineer, or decompile the App
• Remove any copyright or proprietary notices
• Use automated systems (bots, scrapers) to access the Service
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Violate any applicable laws or regulations

You agree to use the Service only for lawful purposes and in accordance with these Terms.

You may NOT:

Content-Related:

• Upload, post, or transmit illegal, harmful, or offensive content
• Upload content that infringes on intellectual property rights
• Upload content that contains malware or harmful code
• Upload content that violates anyone's privacy

Account-Related:

• Create multiple accounts to circumvent restrictions
• Impersonate another person or entity
• Use another person's account without permission
• Share, sell, or transfer your account

Service-Related:

• Interfere with or disrupt the Service or servers
• Bypass any security measures or access controls
• Collect information about other users
• Use the Service to spam or harass others

Business-Related:

• Use the Service for unauthorized commercial purposes
• Resell or redistribute the Service
• Create a competing service using our technology

"User Content" includes:

• Cat meow recordings
• Cat profile information and photos
• AI chatbot conversations
• Survey responses
• Any other content you upload or create

You retain ownership of your User Content. However, by uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to:

• Store and process your content to provide the Service
• Use anonymized data for AI training and improvement
• Display your content within your account
• Create backups for security purposes

Your User Content must:

• Be accurate and not misleading
• Comply with applicable laws
• Not infringe on anyone's rights
• Not contain harmful or malicious code

We reserve the right to:

• Remove any User Content that violates these Terms
• Remove content if required by law
• Remove content reported for policy violations

We are not obligated to monitor User Content but may do so.

While we maintain backups, you are responsible for:

• Maintaining your own backups of important content
• Understanding that we cannot guarantee against data loss

SuperCat.AI and all related content, features, and functionality are owned by us and protected by:

• Copyright laws
• Trademark laws
• Patent laws
• Trade secret laws
• Other intellectual property rights

Protected Elements:

• The SuperCat.AI name and logo
• App design, graphics, and user interface
• AI models and algorithms
• Software code and architecture
• Documentation and content

"SuperCat.AI" and related logos are our trademarks. You may not use our trademarks without written permission.

If you provide suggestions, ideas, or feedback ("Feedback"), you grant us the right to use that Feedback without any obligation to you.

IMPORTANT DISCLAIMER:

The AI emotion analysis provided by SuperCat.AI is for informational and entertainment purposes only. It is NOT:

• A substitute for professional veterinary advice
• A diagnostic tool for medical conditions
• 100% accurate or guaranteed to be correct
• Suitable for making critical health decisions

Accuracy:

• AI analysis may not be 100% accurate
• Results may vary based on recording quality
• Individual cat vocalizations may differ
• Background noise can affect accuracy

Not Medical Advice:

• Do not rely solely on AI analysis for health decisions
• Always consult a licensed veterinarian for health concerns
• Seek immediate veterinary care for emergencies

The human-to-cat translation feature is provided for entertainment and informational purposes only. It does not:

• Guarantee actual cat communication
• Replace proper cat training or behavior modification
• Ensure your cat will respond to sounds
• Guarantee any specific outcome

You acknowledge that:

• You use the AI analysis at your own risk
• You will not rely solely on the App for health decisions
• You will seek professional advice when needed
• You understand the limitations of AI technology

We strive to provide the Service 24/7, but we do not guarantee:

• Uninterrupted access to the Service
• Error-free operation
• Freedom from bugs or technical issues

The Service may be unavailable due to:

• Scheduled maintenance (we will provide notice when possible)
• Emergency maintenance or repairs
• Technical issues beyond our control
• Third-party service provider issues

We make no warranty regarding Service availability and are not liable for any interruptions or downtime.

• Limited monthly recordings
• Limited background monitoring
• Limited AI chatbot usage
• Basic emotion analysis
• Advertisements (may be displayed)

Premium Subscription ($4.99/month or $39.99/year):

• Unlimited recordings
• Unlimited background monitoring
• Unlimited AI chatbot
• Advanced analytics
• Ad-free experience
• Priority support
• Export data features

Payment Processing:

• Payments are processed through Apple App Store or Google Play Store
• We do not directly collect or store payment information
• Pricing is in USD (may vary by region)

Billing:

• Subscriptions renew automatically
• You will be charged at the beginning of each billing period
• Price changes will be communicated 30 days in advance

Cancellation:

• You can cancel your subscription anytime
• Cancellation takes effect at the end of the current billing period
• You retain access until the end of the paid period

Refunds:

• Refund requests must be made through Apple App Store or Google Play Store
• We do not directly process refunds
• Refund policies are governed by the respective app store

No Refunds For:

• Partial billing periods
• Unused features or credits
• Account termination due to Terms violations

Free trials may be offered for Premium subscriptions:

• Trial period specified at sign-up
• Automatic conversion to paid subscription unless canceled
• Cancel anytime during trial to avoid charges

We reserve the right to:

• Change subscription prices with 30 days' notice
• Offer promotional pricing or discounts
• Modify features included in each tier

You may terminate your account at any time by:

• Using the in-app account deletion feature (Settings > Account > Delete Account)
• Contacting us at official@supercatai.com

Effect of Termination:

• Most data deleted immediately
• Backups deleted within 90 days
• Some data may be retained as required by law

We may terminate or suspend your account if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• You harm other users or the Service
• We are required to do so by law
• You remain inactive for an extended period

Notice:

• We will provide notice when reasonably possible
• Immediate termination may occur for serious violations

Upon termination:

• Your license to use the Service ends immediately
• You must stop using the Service
• We may delete your data (subject to legal requirements)
• Sections of these Terms that should survive termination will remain in effect

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability
• Security or freedom from errors

WE ARE NOT VETERINARIANS AND DO NOT PROVIDE MEDICAL ADVICE. THE AI ANALYSIS IS FOR INFORMATIONAL PURPOSES ONLY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

Indirect Damages:

• Loss of profits, revenue, or business opportunities
• Loss of data or content
• Emotional distress or mental anguish
• Consequential, incidental, or punitive damages

Service-Related:

• Errors, bugs, or inaccuracies in the Service
• Interruptions or unavailability of the Service
• Unauthorized access to your account or data
• Third-party actions or content

Cap on Liability:

• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater

Some jurisdictions do not allow certain limitations, so these limitations may not apply to you. You may have additional rights under your local laws.

We are not liable for failure to perform due to circumstances beyond our reasonable control, including:

• Natural disasters
• War or terrorism
• Government actions
• Internet or telecommunications failures
• Cyberattacks or security breaches by third parties

You agree to indemnify, defend, and hold harmless SuperCat.AI, its officers, directors, employees, and agents from:

• Claims arising from your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your User Content
• Your violation of any applicable laws

We will:

• Notify you of any claim
• Allow you to control the defense (with our approval)
• Cooperate with your defense

You will:

• Not settle any claim without our written consent
• Pay all costs, damages, and attorney fees

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

We collect and process data as described in our Privacy Policy, including:

• Cat meow recordings
• Profile information
• Usage data
• Device information

By using the Service, you consent to:

• Data collection as described in the Privacy Policy
• International data transfers (to the United States)
• Use of anonymized data for AI training

Your download and use of the App through Apple App Store or Google Play Store is also subject to:

• Apple's Terms and Conditions / Licensed Application End User License Agreement
• Google Play Terms of Service

We reserve the right to modify these Terms at any time.

Minor Changes:

• Posted in the App with 7 days' notice
• Email notification to registered users

Material Changes:

• Posted in the App with 30 days' notice
• Prominent in-app notification
• Email with summary of changes
• May require re-acceptance

Continued use of the Service after changes become effective constitutes acceptance of the new Terms.

If you do not agree to modified Terms:

• Stop using the Service
• Delete your account
• Contact us with concerns

Before filing a legal claim, you agree to:

• Describe your complaint in detail
• Attempt to resolve the issue informally for 60 days

For users in the United States:

Binding Arbitration:

• Most disputes will be resolved through binding arbitration
• Arbitration is instead of court proceedings or class actions
• Conducted under the American Arbitration Association (AAA) rules
• Location: Mutually agreed location or via video conference

Exceptions to Arbitration:

• Small claims court actions
• Intellectual property disputes
• Injunctive relief requests

Class Action Waiver:

• You agree to resolve disputes on an individual basis only
• No class actions, class arbitrations, or representative actions
• This waiver is severable from the rest of the arbitration agreement

Opt-Out:

• You may opt out of arbitration within 30 days of accepting these Terms
• Send written notice to: official@supercatai.com
• Include your name, address, and clear statement of opt-out intent

Disputes will be resolved in accordance with Section 19 (Governing Law).

United States Users:

• Governed by the laws of the State of California, USA
• Excluding conflict of law principles

International Users:

• Governed by the laws of your country of residence
• Or as otherwise required by applicable law

United States Users:

• Exclusive jurisdiction in state or federal courts in San Francisco, California
• Subject to the arbitration agreement in Section 18

International Users:

• Courts of competent jurisdiction in your country

EU users have additional rights under EU law, including:

• Consumer protection laws
• GDPR data protection rights
• Right to file complaints with local supervisory authorities

These Terms, together with the Privacy Policy, constitute the entire agreement between you and SuperCat.AI.

If any provision of these Terms is found to be invalid or unenforceable:

• The provision will be modified to be enforceable
• The rest of the Terms remain in full effect

Our failure to enforce any provision does not waive our right to enforce it later.

You may not assign or transfer these Terms or your account. We may assign our rights and obligations without restriction.

These Terms do not create any agency, partnership, joint venture, or employment relationship.
